Various aspects of intellectual property protection in the sphere of biotechnology inventions are emerging as a subject matter of fierce debate at national and international levels. The issue that is of pressing importance at hand is: Whether Micro-organisms can be granted protection under Patent? The legal frame work in many countries with regards to patenting of micro-organisms is that the micro-organisms are not specifically excluded from patentability, however, in many circumstances micro-organisms are excluded from grant of patent protection on the ground that it is “contrary to well-established natural laws”. So, this paper basically tries to understand and study the patentability of the micro-organisms and the relevance of studying the same. This work also makes a comparison for a better understanding of the topic.
